Storyfinch Terms of Service

These Terms of Service govern your use of Storyfinch, an ebook delivery and mailing-list signup tool for authors.

Please read them carefully before creating an account or using the service.

1. Who we are

In these terms, “Storyfinch”, “we”, “us” and “our” refer to the operator of Storyfinch. You can reach us at [email protected].

“You” means the person or organisation using Storyfinch.

2. What Storyfinch does

Storyfinch is a simple ebook delivery and mailing list signup tool for authors.

It allows authors to:

  • upload reader magnets
  • create public signup pages
  • collect reader email addresses and consent
  • connect supported mailing list providers
  • send secure delivery links
  • track signups, deliveries and downloads

Storyfinch is not a mailing list provider, newsletter platform, publishing platform, ebook retailer, reader app, digital rights management system, legal compliance service or marketing agency.

3. Eligibility

You must be at least 18 years old to create a Storyfinch account.

By using Storyfinch, you confirm that:

  • you can enter into these terms
  • the information you provide is accurate
  • you will keep your account details secure
  • you will use the service lawfully
  • you will comply with these terms

4. Accounts

You are responsible for your Storyfinch account and anything done through it.

You must:

  • use a valid email address
  • keep your password secure
  • not share account access except where permitted
  • tell us promptly if you suspect unauthorised access
  • keep your billing and contact details up to date

We may suspend or close accounts that breach these terms, create risk for the service, or are used in a harmful, unlawful or abusive way.

5. Plans and pricing

Storyfinch may offer free, trial or paid plans.

The expected paid plan is:

Storyfinch Pro: $29 per year

The exact price, features and limits will be shown on the pricing page at the time you subscribe.

Paid subscriptions renew automatically unless cancelled before the renewal date.

We may change prices or plan features in the future. If we make a material change to a paid plan, we will give reasonable notice where required.

6. Free trials and free plans

If Storyfinch offers a free trial or free plan, we may set limits on:

  • number of reader magnets
  • number of deliveries
  • storage
  • integrations
  • branding removal
  • analytics
  • other features

We may change, pause or remove free plans or trials in the future.

A free trial does not guarantee continued free access after the trial period ends.

7. Payment and billing

Payments are handled by Stripe or another payment provider we may use in the future.

By subscribing to a paid plan, you authorise the payment provider to charge your selected payment method.

You are responsible for any taxes, currency conversion fees or payment provider charges that may apply.

If payment fails, we may retry payment, restrict paid features, downgrade your account, suspend access or cancel your subscription.

8. Cancellations

You can cancel your subscription through your account or by contacting us.

Cancellation stops future renewal. Unless otherwise stated or required by law, cancellation does not automatically refund the current subscription period.

You can continue using paid features until the end of the paid period, unless your account is suspended or terminated for breach of these terms.

9. Refunds

Storyfinch is a low-cost annual service.

Our standard refund policy is:

  • If you request a refund within 14 days of your first payment, we will normally refund you.
  • Renewal payments are not normally refunded once the renewal period has started.
  • We may refuse refunds where there has been abuse, excessive usage, breach of these terms or suspected fraud.

Nothing in this section affects any legal rights you may have.

10. Acceptable use

You must not use Storyfinch to:

  • break the law
  • infringe intellectual property rights
  • send spam
  • collect email addresses without appropriate consent
  • mislead readers about what they are signing up for
  • distribute malware, viruses or harmful files
  • upload illegal, abusive or exploitative content
  • impersonate another person or organisation
  • interfere with the operation or security of Storyfinch
  • attempt to access other users’ accounts or data
  • reverse engineer or attack the service
  • overload the service through automated or abusive traffic
  • use Storyfinch for phishing, scams or fraud

We may remove content, block delivery pages, restrict accounts or suspend access if we believe the service is being misused.

11. Author responsibilities

As an author using Storyfinch, you are responsible for:

  • the reader magnets you upload
  • the accuracy of your signup pages
  • your consent wording
  • your mailing list provider settings
  • your privacy notices
  • your marketing emails
  • your compliance with email marketing and data protection laws
  • your relationship with readers
  • your right to distribute uploaded files
  • your tax and business obligations

Storyfinch provides tools to help you collect and record consent, but we do not guarantee that your use of those tools will make your mailing list or marketing legally compliant.

You should take legal advice if you are unsure about your obligations.

12. Reader consent

Storyfinch allows authors to display consent wording and require readers to confirm they want to join the author’s mailing list before receiving a reader magnet.

Storyfinch records the consent wording shown at the time of signup and related technical details.

Authors are responsible for making sure their consent wording is accurate, lawful and reflects what the reader will receive.

Authors must not use misleading wording or add readers to unrelated lists without appropriate permission.

13. Mailing list integrations

Storyfinch may support integrations with mailing list providers such as EmailOctopus, MailerLite, Kit, Mailchimp, Brevo and others.

You are responsible for:

  • having your own account with the mailing list provider
  • complying with that provider’s terms
  • entering correct API keys or connection details
  • selecting the correct list, tag, form, group or sequence
  • checking that subscribers are being added as expected
  • handling unsubscribes and marketing preferences

Integrations depend on third-party services. We do not control those services and cannot guarantee they will always be available, unchanged or error-free.

If an integration fails, Storyfinch may still deliver the reader magnet if the reader has completed the signup flow. We may record the failure and show it in your account so you can take action.

14. Uploaded content and files

You keep ownership of the files and content you upload to Storyfinch.

By uploading content, you give Storyfinch permission to store, process, display, transmit and deliver that content as needed to provide the service.

You confirm that:

  • you own or have the necessary rights to upload and distribute the content
  • the content does not infringe another person’s rights
  • the content is not unlawful
  • the content does not contain malware or harmful code
  • the content complies with these terms

We may remove or restrict access to content if we believe it breaches these terms or creates legal, technical or reputational risk.

15. Secure delivery

Storyfinch is designed to reduce casual file sharing by using secure delivery links, expiring tokens, private file storage and controlled downloads.

Storyfinch does not provide digital rights management.

We cannot guarantee that readers will not copy, forward, share, upload, screenshot or otherwise distribute files after downloading them.

Authors should not upload files to Storyfinch if they require strict DRM-level protection.

16. Reader experience

Readers do not need a Storyfinch account to receive a reader magnet.

Storyfinch may provide simple help pages for opening EPUBs, PDFs and other supported files.

We are not responsible for every reader device, app, email provider or file-opening issue.

17. Service availability

We aim to keep Storyfinch reliable and available, but we do not guarantee uninterrupted service.

The service may be unavailable due to:

  • maintenance
  • upgrades
  • hosting issues
  • third-party provider outages
  • security incidents
  • internet issues
  • technical faults
  • circumstances outside our reasonable control

We may change, suspend or discontinue parts of the service where necessary.

18. Support

Storyfinch may provide support by email or through the app.

We will try to respond within a reasonable time, but we do not guarantee a specific response time unless explicitly agreed in writing.

We may prioritise support based on account status, severity, security risk and operational impact.

19. Data protection

Storyfinch processes personal data as described in our Privacy Policy.

For account, billing, support and product data, Storyfinch is usually the controller.

For reader signup and delivery data collected through an author’s reader magnet, the author is usually the controller and Storyfinch is usually the processor.

The data processing terms in section 20 apply where Storyfinch acts as a processor for an author.

20. Data processing terms

This section applies where Storyfinch processes personal data on your behalf as a processor.

20.1 Processing instructions

Storyfinch will process reader signup and delivery data only as needed to provide the service, comply with these terms, follow your lawful instructions, or meet legal obligations.

20.2 Subject matter and duration

The processing relates to hosting reader magnet signup pages, recording consent, connecting mailing list providers, sending delivery emails, providing secure downloads, logging delivery activity and supporting the service.

Processing continues while your account is active and for any reasonable retention period described in the Privacy Policy or agreed with you.

20.3 Types of personal data

The personal data may include:

  • reader email addresses
  • consent records
  • IP addresses
  • user agents
  • signup timestamps
  • delivery and download records
  • mailing list provider responses
  • support information

20.4 Categories of data subjects

The data subjects are readers who sign up for your reader magnets and, where relevant, people who contact support about a delivery.

20.5 Confidentiality

Storyfinch will restrict access to personal data to people and service providers who need access to provide and support the service.

20.6 Security

Storyfinch will use appropriate technical and organisational measures designed to protect personal data, including access controls, secure storage, HTTPS, private file storage and secure handling of credentials.

20.7 Sub-processors

You authorise Storyfinch to use sub-processors to provide the service.

Sub-processors may include hosting, storage, email, payment, analytics, security, monitoring and support providers.

We will remain responsible for our sub-processors where required by law and will use reasonable measures to ensure they protect personal data appropriately.

20.8 Assistance

Taking into account the nature of the processing and the information available to us, Storyfinch will provide reasonable assistance with data subject requests, security issues and compliance obligations relating to the service.

20.9 Deletion and return

When your account ends, we may delete, return or anonymise personal data processed on your behalf, subject to legal, security, backup and operational requirements.

20.10 Audits

We will provide reasonable information to help demonstrate our compliance with these data processing terms. Any audit must be reasonable, proportionate, agreed in advance and not compromise the security or confidentiality of other users or the service.

21. Intellectual property

Storyfinch, including its software, branding, design, interface, documentation and website content, belongs to Storyfinch or its licensors.

These terms do not transfer ownership of Storyfinch intellectual property to you.

You may not copy, modify, resell, reverse engineer or create derivative works from Storyfinch except where expressly permitted by law or by us in writing.

22. Feedback

If you send us ideas, suggestions or feedback, you allow us to use them without restriction or compensation.

We appreciate feedback, but please do not send confidential ideas unless we have agreed otherwise in writing.

23. Third-party services

Storyfinch integrates with third-party services such as mailing list providers, payment processors, hosting providers and email providers.

Third-party services are governed by their own terms and policies.

We are not responsible for third-party services, including their availability, security, accuracy, changes, pricing or conduct.

24. Beta features

We may offer beta, experimental or early-access features.

Beta features may be incomplete, unstable, changed or removed at any time.

You should not rely on beta features for critical workflows.

25. Suspension and termination

We may suspend or terminate your account if:

  • you breach these terms
  • payment fails
  • your use creates risk for Storyfinch or other users
  • we suspect fraud, spam, abuse or unlawful activity
  • we are required to do so by law
  • continuing to provide the service would create legal, security or operational risk

You may stop using Storyfinch at any time.

Termination does not affect rights or obligations that should reasonably continue after termination.

26. Effect of termination

When your account ends:

  • your access to the app may stop
  • public reader magnet pages may be disabled
  • delivery links may stop working
  • paid features may be removed
  • data may be deleted, retained or exported in line with our Privacy Policy and legal obligations

You should export anything you need before closing your account.

27. Disclaimers

Storyfinch is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • the service will be uninterrupted or error-free
  • every email will be delivered
  • every third-party integration will work at all times
  • every reader will be able to open every file
  • the service will meet every legal or marketing requirement
  • secure delivery will prevent all unauthorised copying or sharing

You are responsible for deciding whether Storyfinch is suitable for your needs.

28. Liability

Nothing in these terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

To the fullest extent permitted by law, Storyfinch will not be liable for:

  • lost profits
  • lost revenue
  • lost business
  • lost goodwill
  • lost data
  • indirect or consequential loss
  • third-party service failures
  • mailing list provider errors
  • reader device or email issues
  • unauthorised sharing of downloaded files

To the fullest extent permitted by law, Storyfinch’s total liability relating to the service will be limited to the amount you paid to Storyfinch in the 12 months before the event giving rise to the claim.

If you use a free plan, our total liability will be limited to £50.

29. Indemnity

If you use Storyfinch in a way that causes claims, losses, damages, costs or expenses for us, you agree to compensate us where those claims arise from:

  • your uploaded content
  • your mailing list practices
  • your breach of these terms
  • your breach of law
  • your infringement of someone else’s rights
  • your misuse of the service

30. Changes to the service

We may improve, change, remove or add features to Storyfinch.

We will try not to remove core paid functionality without reasonable notice, but the service will evolve over time.

31. Changes to these terms

We may update these terms from time to time.

If we make material changes, we will take reasonable steps to notify account holders.

Your continued use of Storyfinch after changes take effect means you accept the updated terms.

If you do not agree to the updated terms, you should stop using Storyfinch and cancel your account.

32. Governing law

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, except where applicable law gives you mandatory rights to bring a claim elsewhere.
